General Provisions

  1. These Terms and Conditions define the terms and rules of:
    1. using the online service called www.auschwitz-visit.pl,
    2. providing electronic services,
    3. selling through the service,
    4. and the procedure for concluding a Sales Agreement with the Seller through the store.
  2. Using the service signifies acceptance of the Terms and Conditions and confirmation that the Client has read, understands, and agrees to comply with them. Acceptance of the Terms and Conditions is equivalent to agreeing to conclude a contract with the Seller for the provision of electronic services in accordance with the Act on the provision of electronic services.
  3. The Terms and Conditions are continuously available on the website https://www.auschwitz-visit.pl/index.php?id_cms=3&controller=cms in a manner that allows for their acquisition, reproduction, and recording of their content by printing or saving on a medium at any time.
  4. The information presented on the Service constitutes an invitation to conclude a sales agreement in accordance with Article 71 of the Civil Code.

§2

Definitions

  1. Service — the online store available at www.auschwitz-visit.pl
  2. Seller — Zakład Komunalny Gminy Oświęcim sp. z o. o.
  3. Client — a natural person, a legal person, or an organizational unit without legal personality, to whom special provisions grant legal capacity, as well as an entrepreneur with consumer rights
  4. Distance Contract — in accordance with Article 2, paragraph 1 of the Consumer Rights Act
  5. Terms and Conditions — this document
  6. Order — purchase made in the Service via an interactive form, purchase made via email or telephone
  7. Order Confirmation — document sent to the email address authorizing the use of the purchased service
  8. Service — service available in the Service described in the product card
  9. Sales Agreement — agreement as defined in Article 535 of the Civil Code

§3

Service Functionality

  1. Through the Internet Service, the Seller enables:
    1. Browsing information posted on the Service
    2. Placing orders using an interactive form
    3. Posting reviews of purchased services
  2. Through the Service, the Client can purchase services

§4

Technical Requirements

  1. To use the Store, the Customer must have:

    1. a device with Internet access

    2. an installed web browser (recommended are: Mozilla Firefox version 24.0 or higher, Opera version 10 or higher, Google Chrome version 28.0 or higher, or MS Internet Explorer version 8.0 or higher)

    3. enabled support for cookies and JavaScript. It is also possible to use other versions of web browsers, provided they ensure full compatibility with those listed above.

  2. To place an order, the customer should have:

    1. access to an active email account

    2. the ability to make a payment using one of the available payment methods

    3. software that allows reading files in PDF format

  3. The seller informs that cryptographic protection of electronic transfer and digital content is used by applying appropriate logical, organizational, and technical measures, particularly to prevent third parties from accessing data, through SSL encryption, use of access passwords, and antivirus or anti-malware programs.

  4. The seller informs that despite the security measures mentioned in sec. 3, using the network and services provided electronically may pose a risk of harmful software entering the Customer's IT system and device or third parties gaining access to data on that device. To minimize this risk, the seller recommends using antivirus programs or measures protecting identification on the Internet.

  5. When using the Service, customers are prohibited from using computer code, programs, or files that harm the Seller (especially server-loading automated scripts or other types of malicious software).

§5

Store Usage Rules

The Client can make a purchase in the service:

  1. Using the electronic form, following the steps:
    1. Select the desired service
    2. Select the date and time and additional services
    3. Add the service to the cart by clicking "Book"
    4. Go to the cart, verify its contents, and confirm by clicking "Proceed to checkout"
    5. Fill out the form with the necessary information and confirm having read: the store's terms and conditions, privacy policy, and information about the right of withdrawal
    6. Select the payment method
    7. Make the payment
  2. Via email, sending the following information:
    1. desired services including the number of people, date, time, and additional services
    2. data necessary for making a reservation
        • names and surnames of participants
        • ticket type
        • contact phone number
      after verifying the order, the Seller will inform about the availability of the Service or indicate other possible dates. Upon Client acceptance, payment instructions will be sent.
  3. By phone, providing the consultant with the following information:
    1. desired services including the number of people, date, time, and additional services
    2. data necessary for making a reservation
        • names and surnames of participants
        • ticket type
        • email address
      after verifying the order, the Seller will inform about the availability of the Service or indicate other possible dates. Upon Client acceptance, payment instructions will be sent via email.
  4. Upon receiving the payment, the Seller will send the Client a reservation confirmation authorizing the use of the Service.
  5. In the case of email and phone reservations, the Client, at the time of placing the inquiry, accepts the provisions of these Terms and Conditions and the privacy policy

Service and Service Usage Rules

  1. The Client is obliged to use the service according to its purpose, in accordance with the law, and general social norms.
  2. All actions leading to the disruption of the Service operation are prohibited.
  3. While using the Services, the Client is obliged to:
    1. Comply with all the rules applicable at the service provision location
    2. Respect the place where they are located and other people simultaneously using the Services, particularly not disturbing the order

Seller Liability Exclusion

  1. The Seller is not liable for:
    1. incorrect data provided by the Client, which in special cases may prevent participation in part or all of the tour.
    2. Client's tardiness — in case of the Client's absence at the specified place and time, the Seller is not obliged to wait for the client.
    3. incorrect payment made if the Client chooses the standard transfer payment method and incorrectly enters the transfer data.
    4. delays due to random reasons that prevent the Client's participation in the tour or part of it.
    5. Client's behavior resulting in exclusion from the tour due to violation of the toured facility's regulations.
    6. Changing the visiting time for reasons beyond the control of the Seller
    7. Property damage caused by the Customer
    8. Personal damage suffered by the Customer in connection with the Services provided

§8

Withdrawal from the Contract

  1. Due to the nature of the services offered, in accordance with Art. 1 section 1 point 12 of the Rights Act Consumer, the Seller does not provide for the possibility of withdrawing from the contract.
  2. Before finalizing the order, the customer accepts the information about the shortage in the interactive form the possibility of withdrawing from the contract, and lack of acceptance makes it impossible to proceed to the next steps order stages.
  3. in the case of services with a set start date, if the Seller fully performs the service before the end of the withdrawal period.
  4. Before finalizing the order via e-mail or telephone, the customerreceives information about the inability to withdraw from the contract

Payment Methods

  1. The user makes the payment for the ordered goods in the manner chosen at the time of placing the order.

  2. The following payment options are available:

    1. By debit or credit card – Stripe, Inc.,

    2. By instant transfer – Przelewy24.pl.

  3. The seller does not accept cash payments.

  4. The payment operator mentioned in § 7 sec. 5 point is the platform Stripe.com, owned by Stripe Technology Europe Limited, Ireland, headquartered at 3 Dublin Landings, North Wall Quay, Dublin 1, Dublin, Ireland D01 C4E0.

Complaints

  1. The customer may submit a complaint about the service if it was not provided in accordance with the provisions Regulations.
  2. The complaint should be sent to the Seller's e-mail address, providing:
    1. Customer Data
    2. Order number
    3. Complaint request
  3. The Seller sends a response to the complaint via e-mail.
  4. The deadline for considering a complaint is 14 days from the date of receipt of the complete complaint reports.
  5. Failure to respond within the deadline means that the complaint will be considered positively.

Out-of-court dispute resolution

  1. Only existing customers can benefit from out-of-court dispute resolution consumers.
  2. Detailed information on out-of-court dispute resolution can be found at pages:
    1. district (municipal) consumer ombudsmen, social organizations to which statutory tasks include consumer protection;
    2. Provincial Inspectorates of the Trade Inspection;
    3. Office of Competition and Consumer Protection.
  3. The customer may also use the online dispute resolution (ODR) service available at: http://ec.europa.eu/consumers/odr/.
